1. Acceptance of Terms & Global Applicability

By downloading, accessing, or using the digital products, games, web portals, or discussion forums (the “Services”) provided by Soni PixelCraft, you agree to these Terms. If you reside in a jurisdiction where these Terms are prohibited by local law, you may not use the Services.

2. Intellectual Property & End User License Agreement (EULA)

Soni PixelCraft grants you a personal, worldwide, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial entertainment purposes. You may not decompile, reverse engineer, distribute, or create derivative works from our software. All copyrights, trademarks, and in-game assets are the exclusive property of Soni PixelCraft.

3. User-Generated Content (UGC)

Certain features of our Services may allow you to create, upload, post, send, or store content, including but not limited to in-game creations, text, images, avatars, audio, or forum posts (“User-Generated Content” or “UGC”).

• License to Soni PixelCraft: While you retain ownership of your UGC, you grant Soni PixelCraft a worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, copy, modify, distribute, publish, and translate your UGC in connection with operating and promoting the Services.
• Content Restrictions: You agree not to post UGC that is illegal, defamatory, harassing, sexually explicit, discriminatory, or infringes on the intellectual property rights of any third party.
• Moderation & Removal: Soni PixelCraft assumes no responsibility or liability for UGC. We reserve the right, but are not obligated, to monitor, review, edit, or remove any UGC at our sole discretion, at any time, and without prior notice.

4. Community Guidelines and Forum Conduct

When participating in Soni PixelCraft’s discussion forums or community spaces, you agree to treat other users with respect. You strictly agree NOT to use the forums to:

• Post abusive, threatening, defamatory, or hateful content.
• Distribute spam, malware, phishing links, or unauthorized advertising.
• Dox (reveal personal information about) other users or Soni PixelCraft staff.
• Share pirated software, game cheats, hacks, or exploits.

Soni PixelCraft is not responsible for the opinions or content posted by users in the forums. We reserve the right to lock threads, delete posts, or permanently ban accounts that violate these guidelines without warning or explanation.

5. Copyright Infringement and Takedown Policy

Soni PixelCraft respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or posted on our discussion forums or Services in a way that constitutes copyright infringement, please notify us immediately at contact@sonipixelcraft.com.

Your notice must include: (a) a description of the copyrighted work; (b) the exact URL/location where the material is located on our forum; (c) your contact information; and (d) a statement under penalty of perjury that you are the copyright owner or authorized to act on their behalf. We will promptly investigate and remove infringing content in accordance with applicable digital copyright laws (such as the DMCA or local equivalents).

6. AI-Driven Features and Generative Content

Our Services may utilize artificial intelligence (AI), machine learning algorithms, and generative AI models to provide features such as dynamic gameplay, automated content generation, chatbots, or personalized recommendations.

• Nature of AI Outputs: You acknowledge that AI-generated content is probabilistic and may sometimes produce inaccurate, unpredictable, or inappropriate results. AI-generated outputs are provided “as is” and should not be relied upon for factual accuracy or professional, legal, or medical advice.
• AI Inputs: By submitting prompts, text, or data into our AI-driven features, you grant us the right to process this data to generate outputs and, where legally permissible, to improve our AI models. You must not submit sensitive personal information or third-party copyrighted material into AI prompts.
• No Liability for AI: Soni PixelCraft expressly disclaims any liability for any damages, offense, or losses caused directly or indirectly by AI-generated content or your reliance on it.

7. Digital Purchases & Local Taxes

All in-app purchases, digital goods, and subscriptions are final and non-refundable, except where local consumer protection laws (such as the EU Consumer Rights Directive or Australian Consumer Law) mandate a refund or withdrawal period. Prices may be adjusted to include local taxes, such as VAT (Europe) or GST (India/Australia), based on your billing location.

8. Global Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SONI PIXELCRAFT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

• Exception for Certain Jurisdictions: Some countries (such as the UK, EU member states, and Australia) do not allow the exclusion of implied warranties or consumer guarantees. In such regions, our warranties are limited to the maximum extent permitted by your local law.

9. Limitation of Liability (Software Defects)

TO THE MAXIMUM EXTENT PERMITTED BY INTERNATIONAL LAW, SONI PIXELCRAFT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM:

• Software bugs, app crashes, server downtime, or glitches.
• Data corruption, breaches, or loss of in-game progress.
• Hardware damage, device bricking, or battery drain from our software.
• Any consequences arising from the use of AI-driven features or user-generated content.

Financial Cap: Our total liability to you shall not exceed the total amount you paid to Soni PixelCraft in the twelve (12) months preceding the claim. (Exception: Where local laws prohibit limiting liability for gross negligence or personal injury).

10. Export Controls and Global Sanctions

You agree to comply with all applicable import/export laws, including U.S. Export Administration Regulations and UN Sanctions. You represent and warrant that you are not located in, under the control of, or a national or resident of any country subjected to a comprehensive U.S. or international embargo, nor are you listed on any global sanctions list.

11. Governing Law, Arbitration, and Class Action Waiver

• Governing Law: These Terms shall be governed by the laws of India, excluding its conflict of law principles.
• Binding Arbitration: Any global dispute arising from these Terms or software issues shall be resolved by binding, confidential arbitration in India, rather than in court.
• Class Action Waiver: You agree that any claims will be brought strictly in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
• EU/UK Consumer Exception: If you are a consumer residing in the European Union or the United Kingdom, you may bring legal proceedings against Soni PixelCraft in the local courts of your country of residence.

12. Indemnification

You agree to defend and indemnify Soni PixelCraft against all global claims, liabilities, damages, and costs arising from your misuse of the Services, your UGC submissions, or your violation of these Terms.
